Upon further testing it seems that GPU acceleration works properly on Baballonia so there is no reason to keep the note.

Not sure actually, we don't have anyone on nvidia to test and I hadn't thought about it until now.

went and asked someone on Nvidia to retest, seems to be an Nvidia issue, should i just go add the note back and add that its an Nvidia only issue?
